CALZADOS PECA’S, S.L.U. (“We”,”us”,”our”,”website owner”). We invite you to access and use our (“website”) www.pecas.com.

All the purchases that are made in our website are subject to the following (“Terms of use”) which may be updated by us from time to time without notice to you. Any (“User”, “customer”) who wishes to make a purchase of product/s in our website agrees completely to the following terms of use. These terms do not cover any re-seller of our products out of our own online shop.

We invite you to read these Terms of use before you make any purchase of one of our (“products”) in our website. If you do not agree to any of these terms you should not proceed to a purchase.

1. Information about our products and offers

We can change offers and conditions, published in our website (prices, products, promotions, and other services). The modifications do not affect already made purchases by our users. The names of Product brands and providers are only used to identify the products. All the photographs, descriptions and prices are not contractual. The special offers, promotions and discounts are valid until the indicated date or until the end of the indicated number of stocks. Same as prices published in the website.

2. How can I make a purchase in this website?

The purchase of our products by the user is made and perfected through the tracking, described in this part. When you buy our products, you accept that all the communication with us is going to be made electronically.

All you need to do to make a purchase on our website, follow these steps:

  1. Select the product you want to buy.
  2. Select the desired color and size.
  3. Once you have completed the above you need to add the selected product/s to the Purchase basket.
  4. In the following step you need to confirm that it is the product you want, the right size and colour.
  5. Then you need to click on the big button “Proceed to checkout”
  6. Once there, you need to fill in all the billing information. Some form fields are marked with a red star, it means they are obligatory.
  7. The following step is finishing the payment through the payment gateway we use. We accept VISA and MasterCard.
  8. The order is complete once you receive the confirmation message, including the list of items you have purchased and a link to these terms of use.

3. Product prices, taxes and customs

The indicated prices next to our products include IGIC.

If there is an error or mistyping a price in one of the viewed products and if a user decides to make a purchase based on this error, we will inform immediately for the mistake and the user will be presented with the opportunity to cancel the purchase without any added expense.

The product price does not include the transport and shipping prices, those prices are presented at the end of the purchase process.

4. What are the shipping conditions?

4. a) Where do we ship?

We ship to all the Canary Islands.

We do not ship to Spain – mainland, Balearic Islands, Ceuta or Melilla.

We do not ship internationally.

4.b) Delivery

The usual delivery estimation is 24 – 72 hours since the payment has been completed. And it also depends on the shipping company.

If the product is out of stock and could not be delivered on time, we will inform you on the estimated time and you will be able to change it for another product or cancel the order.

These delivery estimations are indicative and CALZADOS PECA’S S.L.U. reserves the right to delay them for matters outside the company. We will always try to make the delivery time as short as possible to make sure you receive your purchase fast and in perfect state.

The agreed deadlines for the delivery of the product are understood without prejudice of delays that may be caused by major force.

4.c) What should I do in case of delay or error in the delivery?

In case there is any error, delay or misdelivered product, please contact us as fast as possible. CALZADOS PECA’S S.L.U. will contact the shipping company and initiate investigation on what has happened and will resolve the issue as soon as possible. We will do everything we can and not more than 24 hours later we will contact the user and we will propose a solution of the problem, we will ship an identical package without any added expense.

The user has the right to resolve the contract and the price paid for the product and the shipping if we are not able to deliver it within the agreed time and if the established conditions of the 66th article of Royal Legislative Decree 1/2007, of 16 of November apply, in which is approved the restated text of the General Law of Defense of the Consumers and Users and other complementary laws.

4.d) How much the shipping costs?

The shipping costs re indicated separately in the moment of the placing the order and it’s payed by the customer, that should be accepted just before making the payment.

All of the shipping costs to the Canary Islands are FREE.

4.e) Where will I receive my delivery?

All the purchased products will be delivered to the address the user has filled in the Order form and within the limits of the Canary Islands.

The delivery will be made by the shipping company offered by CALZADOS PECA’S S.L.U.

If the user is not available in the moment of the delivery the shipping company will contact him/her to place a new hour.

CALZADOS PECA’S S.L.U. will track the delivery of the order.

5. Payments

5.a) What type of payments do we accept?

We accept debit and credit cards (VISA and Mastercard) and the payments are authorized by payment gateway.

5.b) Is the card payment secure?

This system is totally confidential and secure and the data will not be showed to any third parties. CALZADOS PECA’S S.L.U. does not save any user payment data. The information is given to the payment gateway of the bank entity.

6. Invoices

The user receives the Original Invoice on paper in the box with the purchased product. The user accepts that, if  the user asks for another Invoice it will be a COPY of the original and it can be send by email. If the user needs a paper copy sent by an ordinary mail, it can be done through our Contact form, selecting “Invoice request”.

7. Returns and Exchanges Policy

7. a) How long is the returns period?

The user has thirty calendar days to decide if he/she wants to return the product, since the day it was received. There is no need of explanations, and no penalty fees, only the fixed Return Price, 6,00€.

Withdrawal period will expire at 30 calendar days since the delivery of the product, received by the user or an authorized third party.

7. b) How can I return a product?

If you want to return your purchase, you must inform us about your decision of cancellation of the contract by an unambiguous statement by postal mail at our address:

You can use the following withdrawal form on paper or fill in the contact form indicating (“Withdrawal”), although you are not obligated to do so, it is enough just communicating it in unambiguous way to us, before the thirty calendar days since the day of delivery of the product have passed.

7. c) Requirements for the rights of withdrawal

If the user decides to withdrawal a purchase once it has been delivered, the user should contact us by email or filling in our contact form, selecting “Purchase reteurn” in the Subject. Once we receive it, we will contact the user to arrange a pick up date with the shipping company.

The fixed Return Price of 6,00€ will be deducted from the total value of the product price to be returned.

The user can return the products by postal mail to the following address:  CALZADOS PECA’S S.L.U. Calle Alcalde Jose Emilio Garcia Gomez, 1, 38003, Santa Cruz de Tenerife (Spain).

In case of withdrawal by the user, the product must be returned directly to us, without any damage and in its original package and not later than 30 calendar days since the day of the comunication of the user’s decision for withdrawal. The Withdrawal deadline will be considered complete if the return of the products is executed before the corresponding period has expired.

7. d) Refund policy

CALZADOS PECA’S S.L.U. will make the full refund of the purchase, deducting the fixed Return Fee (view Shipping and returns), using the same payment method, you have chosen at the checkout, unless you have expressly provided otherwise; in any case, there will not be any penalty expenses on behalf of the refund, if the period of thirty calendar days from the date on which we are informed of the withdrawal have not passed.

If the order was delivered we can retain the refund until we have received the products back. When you return a product, we recommend that you ask for a receipt for the shipment you are making.

For the return is very important that the product has not been used and is kept in its original packaging. We will not accept any stickers, adhesive paper or similar placed by the user on the original package. We reserve our right to deny a refund if the returned Product has been damaged in any way.

If the return process is started because of defects on the Product and the user asks for full refund it can be made in thirty calendar days from the reception of the product. This kind of return does not limit the rights that can assist the user in accordance with the guarantee of product established by the regulation of consumers and users.

8. Legal Guarantee

The products sold by CALZADOS PECA’S S.L.U. are covered by the legal guarantee of 2 years from the date of the delivery for new products in accordance with the provisions of consumer and user regulations.

We do not cover defects, provoked by misuse, neglect or improper handling. The Products sold on our website are intended only for the described use in the specifications of each product.

9. Privacy Policy

CALZADOS PECA’S S.L.U. is committed to comply with the current legislation on the processing of personal data, and the Organic Law 15/99 of 13 December on the Protection of Personal Data (hereinafter LOPD).

10. Complaints and Customer Care

11. Major force causes

CALZADOS PECA’S S.L.U. shall not be responsible for any breach or delay in the fulfillment of any obligations assumed, when it’s due to events that are beyond our reasonable control (“Major force causes”).

The Major force causes shall include any act, event, lack of exercise, omission or accident that is beyond our reasonable control such as a) Strikes, lock-ups or other measures b) Civil commotion, revolt, invasion, threat or terrorist attack, war (declared or not) or threat or war preparations c) fire, explosion, storm, flood, earthquake, sinking, epidemic or any other natural disaster d) Inability to use means of transport; Impossibility of using telecommunications systems; and e) Acts, regulations or governmental restrictions.

The obligations derived by these terms of use shall be suspended during the period of the Major force cause and the deadline to fulfill such obligations shall extend for a period equal to the duration of the Major force cause and we shall put all of the efforts possible to end the major force cause or find a solution that allows us to fulfill our obligations in spite of the major force cause.

12. Partial Nullity

In case any of these terms of use was declared null and void by a final decision issued by a competent authority, the remaining terms and conditions shall remain in effect, without being affected by said declaration of nullity.

13. Applicable legislation and competent courts

Contracts of any Product purchase through our Website and any disputes or claims arising therefrom or relating to its object or celebration (including litigation or non-contractual claims) will be governed by Spanish law.

Any dispute arising hereunder the use of the website or its products shall be submitted to the non-exclusive jurisdiction of the Spanish courts and tribunals of the province of Santa Cruz de Tenerife.

If you are contracting as a consumer, nothing in this clause shall affect your rights that are recognized by the current legislation, and you can always choose to file a claim to uphold your rights in relations to these terms of use before the Judge or Courts that correspond to your home.

14. Online platform for resolving conflicts

Following an obligation of information to notify the consumers established in Article 14 of Regulation (EU) 524/2013 on Resolution of online disputes in the matter of consumption CALZADOS PECA’S S.L.U. informs you that the European Commission has launched a web platform for resolving conflicts and it is available on the following address https://webgate.ec.europa.eu/odr/main/index.cfm?event=main.home.show&lng=ES there can be filed claims from residents of the EU for finding an outside of the courts solution.

15. Notifications

Occasionally, CALZADOS PECA’S S.L.U. can utilize your personal data to send you notifications by email with the purpose to inform you about modifications in our products or services.
